Welcome to Vibrantissimo, a premier platform for booking luxury vacation rentals. By accessing or using our services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before proceeding. If you do not agree to these terms, you must not use our platform.
1. Definitions
1.1 “Vibrantissimo” refers to the platform and its operators.
1.2 “User” refers to any individual or entity accessing or using the services provided by Vibrantissimo.
1.3 “Service Fee” refers to the fee charged by Vibrantissimo, amounting to 10% of the total booking value, payable at the time of booking.
2. Services Provided
2.1 Vibrantissimo facilitates the booking of luxury vacation rentals.
2.2 Vibrantissimo does not own or manage rental properties and acts solely as an intermediary between users and property owners.
3. User Obligations
3.1 Users agree to provide accurate and complete information during the booking process.
3.2 Users must pay the 10% Service Fee upon booking. This fee is non-refundable.
3.3 Users are required to ensure that all activities conducted during their stay comply with local laws and regulations.
3.4 Users are responsible for any damages or breaches of rental agreements during their stay.
4. Booking and Payment Terms
4.1 Users may choose to pay only the Service Fee through Vibrantissimo or the full cost of the booking.
4.2 All payments must be made in accordance with the timelines and methods specified at the time of booking.
5a. Cancellation and Refund Policy For Guests
5.1 Service Fee: The 10% Service Fee is non-refundable under all circumstances.
5.2 Full Cost Payments: If a user pays the full cost of the booking through Vibrantissimo:
• Cancellations made more than 90 days before the booking start date are eligible for a full refund.
• Cancellations made between 30 and 90 days before the booking start date are eligible for a 50% refund.
• Cancellations made less than 30 days before the booking start date are not eligible for any refund.
5.3 Refunds, where applicable, will be processed within 14 business days of receiving a cancellation request.
5b. Cancellation and Refund Policy for Hosts
5.4 Host Plan Subscriptions: Plans may be cancelled at any time but no plan subscriptions shall be refunded under any circumstances.
6. Privacy and Data Use
6.1 Vibrantissimo respects user privacy and handles personal data in compliance with applicable data protection laws.
6.2 By using Vibrantissimo, users consent to the collection, use, and processing of their data as outlined in our Privacy Policy.
7. Liability Disclaimer
7.1 Vibrantissimo is not liable for issues arising from the rental property, including but not limited to property condition, availability, or disputes with property owners.
7.2 Vibrantissimo’s total liability, if any, shall not exceed the Service Fee paid by the user.
8. Governing Law
8.1 In respect of Vibrantissimo, these Terms and Conditions shall be governed by and construed in accordance with the laws of Spain.
8.2 Any disputes involving Vibrantissimo, arising out of these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Spain.
8.3 Any disputes arising from a property hosted on Vibrantissimo, or a host using Vibrantissimo, will be governed by and construed in accordance with the relevant statute of the country where the property is located.
9. Amendments
9.1 Vibrantissimo reserves the right to amend these Terms and Conditions at any time.
9.2 Users will be notified of any significant changes via email or platform notifications.
